Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the Tenderup platform and related services (the "Service") provided by Tenderup Pty Ltd ("Tenderup", "we", "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

Tenderup is a construction tendering platform that helps estimators upload drawings, run AI symbol detection and take-off, cost projects, and generate tenders. We may add, change or remove features from time to time.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us promptly of any unauthorised use. You must be authorised to act on behalf of the company associated with your account.

4. Subscriptions and payment

Paid plans are billed in advance on a recurring basis in Australian dollars. Fees are non-refundable except as required by law. We may change pricing on reasonable notice; changes take effect at your next billing cycle.

5. Your content

You retain all rights in the drawings, tenders, pricing and other content you upload or create ("Your Content"). You grant us a limited licence to host, process and display Your Content solely to provide the Service to you. You are responsible for ensuring you have the rights to upload Your Content.

6. Acceptable use

You agree not to:

  • Use the Service unlawfully or in breach of these Terms;
  • Upload content that infringes the rights of others or contains malicious code;
  • Attempt to gain unauthorised access to the Service or other accounts; or
  • Resell, reverse engineer or misuse the Service.

7. AI outputs and estimates — important

AI symbol detection, take-off counts, costings and generated tenders are provided as tools to assist estimators. They may contain errors or omissions and are not a substitute for professional judgement. You are responsible for reviewing and verifying all outputs before relying on them or submitting any tender. Tenderup does not guarantee the accuracy or completeness of any output.

8. Intellectual property

The Service, including its software, design and content (excluding Your Content), is owned by Tender Up and protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the right to use it in accordance with these Terms.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our total liability arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the relevant claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service. On termination, your right to use the Service ceases.

11. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

12. Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Continued use of the Service constitutes acceptance of the updated Terms.
